These Official Contest Rules (the "Rules") govern the promotional contests offered through the Lone Survivor application and website at
https://www.playlonesurvivor.com (the "Platform"). Two contests are currently offered: the
Grand Challenge and the
$1,000 Monthly Lone Survivor Contest (each, a "Contest"). By participating in a Contest, you agree to be bound by these Rules and by the decisions of the Sponsor, which are final and binding in all matters relating to the Contests. These Rules should be read together with the Lone Survivor Terms & Conditions and Privacy Policy.
Part A — Terms That Apply to All Contests
1. No Purchase Necessary
No purchase, payment, entry fee, token, or membership of any kind is necessary to enter or win any Contest, and none will improve your chances of winning. Participation is completely free. Each prize is provided and paid for by the Sponsor; no prize is funded by participant contributions of any kind. Making any purchase, if purchases are otherwise offered on the Platform, does not increase your chances of winning.
2. Sponsor
The Contests are sponsored and administered by Predicta Future Inc., 251 Little Falls, Wilmington, DE 19808 (the "Sponsor"). The Contests are not sponsored, endorsed, administered by, or associated with Apple Inc., Google LLC, any app store or platform, any sports league or team, or any sportsbook or gaming operator. Any references to real sporting events or teams are for identification purposes only.
3. Eligibility
Each Contest is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older (or the age of majority in their jurisdiction, whichever is greater) at the time of participation. Employees, officers, and directors of the Sponsor, and their respective immediate family members (spouse, parent, child, sibling, and their respective spouses) and household members, are not eligible. The Contests are void where prohibited or restricted by law. Participants are responsible for complying with the laws of their own jurisdiction and may not participate if doing so is prohibited where they reside.
4. Entertainment Only; Not Gambling
Lone Survivor is a free, skill-based prediction game offered for entertainment purposes only. No wager, stake, bet, or consideration of any kind is placed or required, and participants can never lose money. Nothing on the Platform constitutes betting, wagering, gambling, or a sportsbook. The Sponsor does not accept bets, hold participant funds at risk, or pay out based on wagers.
5. How to Participate (Free)
To participate, create a free Lone Survivor account and make your prediction(s) as described for the applicable Contest in Part B. No purchase or payment is ever required to participate in or win any Contest. Limit one (1) account per person. Each prediction is one (1) prediction on a real sporting event, subject to the following core mechanic used across the Contests:
- Definition of a "Day." A "Day" runs from 12:00:00 a.m. Eastern Time ("ET") to 11:59:59 p.m. ET, as measured by the Sponsor’s servers. All references to a "day" in these Rules mean a Day as defined here, and all deadlines and cutoffs are measured in ET by the Sponsor’s servers regardless of a participant’s local time zone.
- One pick per Day; submission deadline. A participant may make one (1) prediction per Day on a real sporting event. A Day’s prediction must be submitted no later than 11:59 p.m. ET on that Day. If no prediction is submitted by that time, the participant has made no pick for that Day (see the applicable Contest in Part B for the effect of a missed Day).
- 55% probability cap. The prediction’s implied win probability must be fifty-five percent (55%) or lower at the exact moment of submission, as checked and recorded by the Sponsor’s servers. Picks above 55% are not permitted.
- Picks are final. Predictions are final once submitted and cannot be changed, edited, or withdrawn.
- Server records control. All predictions, submission timestamps, and the 55% implied-probability snapshot are recorded by the Sponsor and are the official, auditable record for resolving the Contest.
6. Determination of Results
Results are determined by the outcome of the underlying real sporting event as recorded by the Sponsor from its designated data source(s). A "push" or "void" occurs where a game is postponed, canceled, or results in an exact-line result, and is treated as described for the applicable Contest. In the event of a discrepancy, ambiguity, or data-source error, the Sponsor may resolve the outcome in good faith, and the Sponsor’s determination is final.
Grading cutoff. For a prediction to be graded for a given Day, the underlying sporting event must be completed and officially settled by 12:00 p.m. (noon) ET on the calendar day immediately after that Day. This allows events that begin during a Day but finish after midnight ET (for example, late West-Coast games) to be graded for the Day on which the pick was made. If the event is not completed and officially settled by that noon-ET cutoff — for example, a game that is postponed, suspended, or still in progress — the prediction is treated as a push/void for that Day and is handled as described for the applicable Contest in Part B. For an event that spans more than one calendar day, the prediction is graded on the event’s official final result if that result is settled by the noon-ET cutoff; otherwise the prediction is treated as a push/void for that Day.
7. Winner Verification & Prize Claim
An apparent winner is not a confirmed winner until verified. Before any prize is awarded, the apparent winner must, within the period stated for the applicable Contest in Part B, complete and return the documents the Sponsor requires, which will include an Affidavit of Eligibility, a Liability & Publicity Release, a completed IRS Form W-9, and government-issued photo identification for identity and age verification, and must pass the Sponsor’s integrity review (Section 11). Prizes are awarded only to the verified, eligible account holder whose registered information matches the verification documents. Failure to respond, failure to return required documents by the deadline, inability to verify eligibility, or any violation of these Rules results in forfeiture, and the Sponsor may (but is not obligated to) select an alternate eligible participant. If required documents are returned as undeliverable, or a potential winner cannot be contacted at the email associated with their account, the prize may be forfeited.
8. Taxes
Except as expressly stated for a particular Contest in Part B, each winner is solely responsible for all federal, state, and local taxes and any other costs and expenses associated with acceptance and use of a prize. For any prize (or aggregate prizes awarded to one person in a single calendar year) of six hundred dollars ($600) or more, the Sponsor will report the prize to the Internal Revenue Service on IRS Form 1099-MISC, and the winner must submit a completed IRS Form W-9 before the prize is released. If a winner fails to provide a valid Form W-9 or taxpayer identification number, the Sponsor may apply backup withholding at the then-current federal rate or withhold the prize until proper documentation is provided. Winners should consult their own tax advisor regarding the consequences of accepting a prize.
9. Publicity
Except where prohibited by law, participation constitutes each participant’s consent for the Sponsor to use the winner’s username (and, where a separate release is signed, likeness) to announce and promote the result, without further notice, review, or compensation. The Sponsor will not publish a winner’s full legal name, email, or contact information without separate consent, except as required by law.
10. Privacy
Information collected in connection with the Contests is handled in accordance with the Sponsor’s Privacy Policy, available at
https://www.playlonesurvivor.com/privacy. By participating, you acknowledge the collection and use of your information as described there.
11. General Conditions & Integrity
One (1) account per person. The following are strictly prohibited and result in disqualification: maintaining or using multiple accounts; use of bots, scripts, or any automation to submit predictions; collusion or coordinated play among participants; exploiting bugs; and any other manipulation, tampering, or fraud. All predictions, timestamps, and the 55% probability snapshot are recorded and auditable. The Sponsor reserves the right, in its sole discretion, to disqualify any participant it reasonably believes has violated these Rules or acted in an unsportsmanlike or disruptive manner, and to void predictions affected by fraud or technical error. The Sponsor may modify, suspend, or terminate a Contest if fraud, a technical failure, a data-source failure, or any other cause beyond its reasonable control compromises the integrity or proper administration of the Contest. If a Contest is terminated early for such a reason, the Sponsor may, in its discretion, determine the winner from among eligible participants based on the recorded results up to the time of termination.
12. Release & Limitation of Liability
By participating in a Contest, each participant agrees to release, indemnify, and hold harmless the Sponsor and its parent, subsidiaries, and affiliates, and their respective officers, directors, employees, agents, and representatives (collectively, the "Released Parties"), from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) participation in any Contest; (b) the acceptance, receipt, possession, use, or misuse of any prize; (c) any human error or any technical malfunction or failure of any network, server, hardware, or software; (d) any lost, late, incomplete, misdirected, delayed, or garbled entries or predictions; (e) any error in the collection, recording, grading, or processing of predictions or results; or (f) any injury or damage to persons or property. The Released Parties are not responsible for typographical, printing, or other errors in these Rules or in any Contest-related materials.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, AND THE AGGREGATE LIABILITY OF THE RELEASED PARTIES ARISING OUT OF OR RELATING TO ANY CONTEST WILL NOT EXCEED THE VALUE OF THE PRIZE THE CLAIMING PARTICIPANT IS VERIFIED TO HAVE WON, IF ANY. Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of the foregoing may not apply to you.
13. Governing Law; Binding Arbitration; Class-Action Waiver
Governing law. These Rules and any dispute arising out of or relating to the Contests are governed by the laws of the State of Delaware (the Sponsor’s state of incorporation), without regard to its conflict-of-laws principles.
Informal resolution first. Before initiating arbitration, a party must send a written notice of dispute to the other describing the claim and the relief sought — to the Sponsor at
baronwins9@gmail.com — and the parties will attempt in good faith to resolve the dispute within sixty (60) days.
Binding individual arbitration. Except for (i) claims that qualify for small-claims court and (ii) claims seeking injunctive or equitable relief regarding intellectual property, any dispute, claim, or controversy arising out of or relating to a Contest or these Rules that is not resolved informally shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, rather than in court. The arbitration will be conducted in Wilmington, Delaware, or, at the participant’s election, in the participant’s county of residence or by telephone or video where available. The arbitrator’s award may be entered in any court of competent jurisdiction. This arbitration agreement is governed by the Federal Arbitration Act.
Class-action and jury-trial waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, ALL CLAIMS MUST BE BROUGHT IN A PARTY’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS OR PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING. EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall be severed and brought in a court of competent jurisdiction located in Delaware, while all other claims proceed in arbitration.
Time to file. To the extent permitted by law, any claim must be brought within one (1) year after it arises, or it is permanently barred.
14. Winners List
For the username of a Contest winner, send a request to
baronwins9@gmail.com, or by mail to Winners List, Predicta Future Inc., 251 Little Falls, Wilmington, DE 19808, within ninety (90) days after the applicable Contest ends.
Part B — Contest-Specific Rules
Contest 1 — The Grand Challenge ($5,000,000)
Challenge Period. The Grand Challenge is ongoing and has no fixed end date. It runs continuously until a participant wins the grand prize, at which point this Contest ends; the Sponsor may launch a new challenge thereafter. The Sponsor may suspend or end the Grand Challenge as provided in Section 11.
How to Win — 45 Correct Predictions in a Row. The first participant to achieve a streak of forty-five (45) correct predictions in a row wins the grand prize. The streak works as follows:
- Each Day, a participant may make one (1) prediction on a real sporting event, subject to the 55%-or-lower implied-probability cap and the submission deadline in Section 5.
- A correct prediction advances the participant’s streak by one (1).
- A wrong prediction resets the streak to zero (0).
- A push/void (game postponed, canceled, an exact-line result, or an event not settled by the grading cutoff in Section 6) is neutral: the streak neither advances nor resets, that Day does not count, and the participant continues.
- A missed Day (no prediction submitted by 11:59 p.m. ET) does not advance the streak; the participant may begin or continue a streak on a following Day, subject to these Rules.
- Streaks are re-enterable: after a reset, a participant may begin a new streak the next Day. Every Day is a potential Day 1.
- The first participant to reach a streak of forty-five (45) correct predictions wins the grand prize, at which point the Grand Challenge ends.
- Ties. If two (2) or more participants reach 45 on the same Day, they split the single grand prize equally. No scenario awards more than one grand prize.
Grand Prize. One (1) grand prize of $5,000,000 in cash. No cash equivalent, substitution, or transfer except at the Sponsor’s sole discretion. The grand prize is backed by the Sponsor and secured through prize-indemnity coverage.
Prize Claim Period. The apparent winner must complete verification under Section 7 within ninety (90) days of being notified at the email on their account.
Taxes (Grand Challenge). The winner is solely responsible for all federal, state, and local taxes on the grand prize; the Sponsor does not gross up or otherwise pay the winner’s taxes. The Sponsor will report the prize on IRS Form 1099-MISC and issue it to the winner, and the winner must submit a completed IRS Form W-9 before the prize is released. A prize of this value has significant tax consequences, and the winner should consult their own tax advisor.
Contest 2 — $1,000 Monthly Lone Survivor Contest
Contest Period. A new Monthly Lone Survivor Contest begins on the first (1st) Day of each calendar month and runs Day-by-Day until a winner is determined. A Contest may conclude in fewer than the full number of Days in the month if only one participant remains. Each participant makes one (1) prediction per Day beginning on the 1st.
How to Enter (Free). Create a free Lone Survivor account and enter the Contest at no cost before it begins. Registration for each monthly Contest opens when the Contest is posted in the app and closes at 12:00:00 a.m. ET on the first (1st) Day of that month; no entries are accepted after a Contest has begun. Limit one (1) entry per person/account per monthly Contest. All entrants begin together on Day 1.
How to Win — Survivor Format. The Monthly Lone Survivor Contest is a daily elimination ("survivor") contest:
- Each Day of the Contest, make one (1) prediction on a real sporting event. The pick’s implied win probability must be fifty-five percent (55%) or lower at the moment of submission, and the pick must be submitted by 11:59 p.m. ET that Day.
- A correct pick keeps you alive (you "survive").
- A wrong pick, or a missed Day (no pick submitted by the deadline), eliminates you.
- A postponed/canceled game, a push, or an event not settled by the grading cutoff voids the pick: you survive but owe two (2) picks the next Day, per the in-app rules.
- The last remaining player (the "Lone Survivor") wins the prize.
- Ties. If all remaining players are eliminated on the same Day, those finalists split the prize equally.
Prize. One (1) prize of $1,000, delivered as gift card(s) or cash at the Sponsor’s discretion, funded entirely by the Sponsor. No cash or other substitution except at the Sponsor’s discretion. The prize amount shown when a Contest opens is the prize awarded and is not changed after entry opens.
Winner Notification & Delivery. The winner is notified by email at the address on their account within seven (7) days of the Contest’s conclusion and must respond within fourteen (14) days to claim, or an alternate may be selected. Prizes are delivered by emailed gift card(s) or an agreed method after verification under Section 7 is complete.
Taxes (Monthly Contest). The winner is responsible for all applicable taxes. Because the $1,000 prize meets or exceeds the $600 IRS reporting threshold, the Sponsor will report the prize on IRS Form 1099-MISC, and the winner must submit a completed IRS Form W-9 before the prize is delivered. If the winner does not provide a valid Form W-9 or taxpayer identification number, the Sponsor may apply backup withholding or withhold the prize until proper documentation is provided.
